Privacy Policy and Terms of Service

You may CANCEL your Personal Care Calling Services at any time, for any reason, simply by calling or emailing PCCS — whether your calls are provided to you at no cost as a donated service, or through a paid subscription. Because subscription payments are also charitable donations to PCCS, the same simple cancellation process applies to both: no forms, no fees, no waiting period.

 

Personal Care Calling Services, Inc., established in 2014, is a heart-centered nonprofit organization dedicated to enhancing the quality of life for seniors, veterans, and individuals living alone or with disabilities. Our core services include daily reassurance care calls and medication reminders, delivered through live and automated outreach. We are committed to providing compassionate support and assistance to those in need, ensuring their well-being and peace of mind. Our team is devoted to making a positive impact in the lives of those we serve, offering personalized care and attention to each individual. Through our unwavering dedication, we strive to create a sense of community and belonging for everyone we serve.

 

Privacy Policy
Personal Care Calling Services, Inc., a Florida nonprofit corporation and federally recognized 
501(c)(3) organization, promises never to sell or improperly disclose the personal, health-related, 
or financial information of those we serve. You are a valued member of our community, and PCCS 
exists to serve your needs as they pertain to our services.


Information we handle. In the course of providing reassurance calls, medication reminders, and 
care- circle escalation, we collect and maintain certain personal information, which may include 
names, contact details, the contact information of designated care contacts, scheduling 
preferences, and information related to wellness check-ins and medication reminders. We use this 
information solely to deliver and support the services you have requested.


Emergency information you choose to share. As part of enrollment, we may ask whether there is any 
medical information that emergency responders would need to know before providing care to you; for 
example, a medication you take or a condition that could affect how you are treated if you are 
unconscious or unable to speak. Providing this information is entirely voluntary, and we collect 
only what you choose to share. Any such information is kept private and is disclosed only to 
emergency services, such as EMTs, paramedics, or law enforcement, and only when needed to protect 
your safety during an emergency wellness check or medical response. By providing this information 
and using our service, you consent to this limited emergency disclosure.


How we protect it. Your information is stored within a secure, HIPAA-compliant cloud environment, 
protected by current information-technology safeguards including encryption and access controls. 
While no system can guarantee that breaches or unauthorized access will never occur, we work 
diligently to prevent them, and we will notify affected individuals if such an event ever takes 
place, as required by applicable law.


Your acknowledgment. Upon enrollment, we provide a copy of this Privacy Policy and Terms of Service 
by email to recipients and designated Care Circle contacts who use email. For those who do not use 
email, we will read the relevant portions aloud so that you understand how your information is used 
and shared. This Privacy Policy and Terms of Service is also always available at www.pccs.care. By 
subscribing to and using the service with this knowledge, you acknowledge and agree to these 
practices.


Our top priority is to serve you as promised while protecting the privacy of your personal, health, 
and financial information.

 

Terms & Conditions
By using the Personal Care Calling Services website (www.pccs.care) and the Personal Care Calling 
Services platform, the Account Owner, Subscriber, Client, and Loved One (collectively, the 
“Customer”) subscribe to the live and automated telephone service (the “Personal Care Calling 
Services”) offered by Personal Care Calling Services, Inc., a Florida nonprofit corporation and 
federally recognized 501(c)(3) organization (“PCCS”), and agree to these terms and conditions.


1) Not for Emergencies. Personal Care Calling Services should not be used in the event of any 
emergency. For Customers in the USA — IN THE EVENT OF AN EMERGENCY, DIAL 9-1-1. For Customers 
outside the USA, please dial your national emergency number. Customer acknowledges and agrees that 
the Personal Care Calling Services and the supporting infrastructure (the “Infrastructure”) are not 
warranted to be suitable in life-threatening or other emergency situations where the failure or 
potential failure of the service or Infrastructure can cause injury, harm, death, property damage, 
or other grave problems, including, without limitation, delays in obtaining medical care or other 
emergency services. Customer acknowledges and agrees that the Infrastructure relies upon the 
internet and telephone networks, and that the service may experience interruptions, errors, or 
omissions due to technical issues, acts of God, or other acts or omissions, whether or not within 
the control of PCCS.


2) Authorization and Consent. Account Owner represents and warrants that Account Owner has obtained 
(or will obtain prior to the first transmission of the service) the authorization of any Care 
Contacts and the Loved One: (a) to subscribe to the Personal Care Calling Services; (b) to create, 
maintain, use, and transmit personal and other information regarding the Loved One to Care Contacts 
and the Account Owner; and (c) to enter into these terms and conditions on behalf of Care Contacts 
and the Loved One. Customer acknowledges and agrees that they are solely responsible for the 
selection of Care Contacts and the Loved One, and for the selections made with respect to the 
content to be transmitted as part of the service. By enrolling, recipients and their authorized 
representatives consent to receive automated and live wellness check-in and medication-reminder 
calls, and designated Care Contacts consent to receive escalation calls.


3) Emergency Wellness Checks and Information Sharing. Customer understands and agrees that, when a 
recipient cannot be reached through PCCS's automated and live call attempts and the designated Care 
Contacts cannot be reached or resolve the concern, PCCS may request an in-person wellness check 
from local emergency services or law enforcement. In connection with such a wellness check or any 
emergency medical response, PCCS may share information the recipient has voluntarily provided — 
including any medication or medical information offered for that purpose — with EMTs, paramedics, 
law enforcement, or other emergency responders, solely to protect the recipient's safety. Because 
this disclosure is made at the recipient's request and with the recipient's prior knowledge and 
consent, Customer agrees that PCCS shall not be held responsible or liable for sharing such 
information with emergency responders.


4) Text Messaging (SMS) Communications. As part of enrolling in the Personal Care Calling Services, 
recipients and designated Care Contacts may consent to receive automated and live text messages 
related to scheduled wellness check-in reminders, medication reminders, and Care Circle escalation 
alerts. Message frequency varies based on the recipient's chosen calling schedule. Message and data 
rates may apply depending on your mobile carrier and service plan. You may reply HELP at any time 
for assistance, or reply STOP at any time to opt out of receiving text messages. Opting out of text 
messages does not affect your enrollment in live or automated phone call services, which will continue as

scheduled. This Privacy Policy and Terms of Service, which governs text messaging communications, 
is available at any time at www.pccs.care.


5) Limitation of Liability. Customer acknowledges and agrees: (a) to hold harmless and indemnify 
PCCS and its employees, officers, members, managers, agents, and suppliers from any claim, demand, 
loss, liability, or expense (including reasonable attorney's fees, whether or not a lawsuit is 
filed, and on all appeals) for any and all interruptions, errors, or omissions with respect to the 
service or any violation of this Agreement; and (b) neither PCCS nor its employees, officers, 
members, managers, agents, or suppliers shall be liable for any damages whatsoever, including but 
not limited to direct, indirect, incidental, consequential, special, or other damages, whether 
arising in contract, negligence, tort, under statute, in equity, at law, or otherwise. Without 
limiting the foregoing, neither PCCS nor any of its employees, officers, members, managers, agents, 
or suppliers shall be liable in any event for any damages for wrongful death, emotional distress, 
bodily harm or injury, or property damage.


6) NO WARRANTY. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE PERSONAL CARE CALLING 
SERVICES ARE PROVIDED BY PCCS AND ITS SUPPLIERS “AS IS” AND “AS AVAILABLE” WITHOUT ANY CONDITION OR 
WARRANTY WHATSOEVER. ALL CONDITIONS AND WARRANTIES, WHETHER EXPRESS OR IMPLIED, ARE DISCLAIMED BY 
PCCS AND ITS SUPPLIERS, INCLUDING, WITHOUT LIMITATION, THE IMPLIED CONDITIONS AND/OR WARRANTIES OF 
MERCHANTABILITY, TITLE, NONINFRINGEMENT, AND FITNESS FOR A PARTICULAR PURPOSE.


7) Network and Data Storage. Customer acknowledges and agrees that the service stores Customer- 
related information within a secure, HIPAA-compliant cloud environment. Customer further 
acknowledges that, within that environment, content may be stored on servers that are not 
necessarily segregated or in a separate physical location from servers on which other similar 
content is transmitted or stored.


8) Subscriptions as Donations; Payment Terms. PCCS is a nonprofit organization. Subscription 
payments to PCCS are made and accepted as charitable donations in support of the organization's 
mission. At the time of sign-up, Customer is informed that the chosen subscription amount, whether 
monthly or annual, is a donation to PCCS. Because these payments are charitable donations, they are 
nonrefundable, and there are no refunds or credits for partial periods of service. Donations may be 
tax-deductible to the extent allowed by law; PCCS does not provide tax advice, and Customers should 
consult their own tax advisor regarding deductibility. PCCS reserves the right to refuse or 
discontinue service to anyone, for any reason, at any time.


9) Modifications to the Service and Donation Levels. PCCS reserves the right at any time to modify 
or discontinue, temporarily or permanently, the service (or any part of it) with or without notice. 
Suggested donation levels and service plans are subject to change upon 30 days' notice, which may 
be provided by posting the changes to the PCCS website or within the service itself. PCCS shall not 
be liable to Customer or any third party for any modification, change, suspension, or 
discontinuance of the service.


10) Entire Agreement. These terms and conditions contain the entire agreement between PCCS and 
Customer. There are no representations, conditions, or statements material to these terms and 
conditions unless specifically and expressly stated herein. Customer has not relied upon any 
representations not contained in these terms and conditions. PCCS shall not be responsible for any 
promise, condition, warranty, or representation made by any of its representatives, employees, or 
agents unless given by PCCS in writing.

11) Termination. Customer may terminate the Personal Care Calling Services at any time as provided 
through the service. Sections 5, 6, and 12 of these terms and conditions shall survive any such 
termination.


12) Successors and Assigns. All disclaimers of warranty and liability contained in these terms and 
conditions shall be binding upon the Customer and their successors, assigns, transferees, and 
ultimate users.


13) Amendment, Severability, and Assignment. PCCS reserves the right to alter, modify, update, or 
revise these terms and conditions at any time. Any such changes shall become effective immediately 
upon being posted to the PCCS website. If any provision of these terms and conditions is unlawful, 
void, or unenforceable for any reason, the remaining provisions (and any partially enforceable 
provision) shall not be affected and shall remain valid and enforceable to the maximum extent 
possible. Customer agrees that PCCS may, in its sole discretion, assign these terms and conditions 
to another entity or organization as a result of any merger, acquisition, or reorganization.


14) Governing Law and Jurisdiction. These terms and conditions, and the interpretation of the 
rights and duties of the parties, shall be governed by the internal laws of the State of Florida 
(without regard to conflict-of-laws principles). Customer and PCCS hereby (a) irrevocably submit to 
the exclusive jurisdiction of the courts of the State of Florida in any action or proceeding 
arising out of or relating to these terms and conditions; (b) agree that such courts shall have 
exclusive jurisdiction; (c) waive any defense that Florida is an inconvenient forum; and (d) agree 
that a final, non-appealable judgment rendered by a court of competent jurisdiction shall be 
conclusive and may be enforced in other jurisdictions by suit on the judgment or in any other 
manner provided by law.
